1. Booking
“Berkeley Psychiatrists” enables individuals in the United Kingdom (“Patients”) to connect in real time with participating clinicians (“Clinicians”) via streaming video, chat and instant messaging through the Electronic Patient Record Systems it uses: Semble for patients self funding and Medicus for patients seen via the NHS Right to Choose Scheme.
The purpose of the Services is to enable clinicians to provide professional clinical advice and related services, including referrals. Where agreed with a Clinician, Patients may also obtain privately and NHS funded prescriptions for certain medications (collectively, the “Services”).
By making a self-funded booking with Berkeley Psychiatrists, you confirm that all Services are provided on a private, self-pay basis.
Clinicians at Berkeley Psychiatrists reserve the right to contact your GP where they consider this to be in your best interests.
If you are seen via the NHS Right to Choose Scheme, your clinician will share your diagnostic and titration reports with your GP after your appointment.
By booking an appointment (if you are a self-funding patient), you acknowledge that an electronic medical record (“EMR”) will automatically be created for you on the Semble Platform.
By selecting an appointment slot (if you are seen via the NHS Right to Choose Scheme), you acknowledge that an electronic medical record (“EMR”) will automatically be created for you on the Medicus Platform.
The Semble and Medicus Platforms are accessible via major desktop operating systems (including macOS, Windows, Linux, and Chrome OS). Internet Explorer and non-Chromium versions of Microsoft Edge are not supported. In certain circumstances, a Clinician may elect to conduct the consultation via an alternative secure platform (e.g. Skype or similar). The choice of platform remains at the Clinician’s discretion.
In the event of technical or security issues affecting infrastructure, we may suspend Services or postpone consultations to ensure safety and system integrity. We will seek to minimise disruption. Refunds or compensation will not be provided unless such suspension exceeds 30 days, in which case you may cancel and receive a full refund for the affected consultation.
While appropriate anti-virus and anti-malware protections are used, we do not guarantee that the Website or Platform will be free from malicious software. You are responsible for ensuring adequate security measures on your own devices.
You must not attempt to gain unauthorised access to the Website, Platform, or Services.
By completing a booking or selecting an appointment slots with your clinician(whether by phone or online), you agree to these Terms of Service and our Privacy Policy.
By booking a follow-up, brief follow-up, repeat prescription, or Shared Care Proposal (SCP) appointment, you confirm that you have previously been seen by a Clinician currently providing Services at Berkeley Psychiatrists.
2. Purchase of Services and Cooling-Off Rights (For Self-Funding Patients)
Under consumer protection legislation, you ordinarily have a statutory right to cancel within fourteen (14) days of entering a contract (“Cooling-Off Period”).
If you book an appointment scheduled to occur within 14 days of booking, you expressly request that we begin providing the Services during the Cooling-Off Period and acknowledge that you waive your right to cancel once the Services have commenced. This enables us to reserve Clinician time and commence provision of Services immediately.
All Services are subject to full payment of applicable consultation, administrative and delivery fees in accordance with our published fee schedule.
All fees incurred at the time of booking are the responsibility of the account holder whose details were provided at booking. That individual shall bear full legal responsibility for payment.
We reserve the right to amend our fees at our discretion prior to billing. Services may be withheld, postponed or cancelled if billing information is inaccurate, invalid, or insufficiently funded.
You authorise Berkeley Psychiatrists to pre-authorise and/or charge your nominated debit or credit card prior to confirming or delivering Services.
3. Prescribing Medication
Prescriptions will only be issued where the Clinician considers it clinically appropriate and in your best interests.
There is no guarantee that a prescription will be issued. Prescribing decisions are made solely at the Clinician’s discretion and subject to applicable policies and regulatory limitations.
Self-funding patients are responsible for both the prescription fee and the cost of medication, which is set independently by the dispensing pharmacy.
Prescriptions issued for patients seen via the NHS Right to Choose Scheme are issued via the NHS Electronic Prescribing Service (EPS).
Prescriptions issued are valid only at lawful UK pharmacies and for your personal use. You must carefully read and follow all instructions provided. If you have questions regarding prescribed medication, you should consult your Clinician, another doctor, or a pharmacist before taking the medication.
4. Delivery of Medication (for Self-Funding patients)
Following consultation, a Clinician may issue a prescription. Prescriptions may be sent directly to an appropriate pharmacy. Dispensing and delivery are undertaken by the pharmacy, not Berkeley Psychiatrists.
There is no guarantee that lost documents (including prescriptions or reports) will be reissued. Where reissuance is agreed, a fee may apply.
5. Electronic Medical Records (EMR)
Your EMR is created to document consultations and store personal health information in accordance with UK legal obligations.
It is your responsibility to ensure that information provided during consultations is accurate. Berkeley Psychiatrists does not guarantee maintenance of a comprehensive record of all data arising from use of Services beyond statutory requirements.
By requesting/selecting a consultation, you consent to the relevant Clinician accessing your EMR for the purposes of providing care.
6. Consultations
Appointments are subject to availability. Confirmation will be sent by email. If confirmation is not received within 24 hours (or within 4 hours if the appointment is imminent), you must contact us.
We may amend or cancel appointments where necessary.
You may be required to present valid UK photographic identification during consultation for prescribing verification purposes.
7–8. Rescheduling, Late Arrival and Cancellation (for Self-Funding patients)
Appointments cannot be rescheduled within five (5) working days of the appointment date.
You may join a consultation up to fifteen (15) minutes after the scheduled start time. After this period, the session may be treated as missed.
Cancellation Policy:
Missed appointments are charged in full unless attributable to Clinician non-attendance, in which case a refund will be issued.
9. Refunds and Disruptions (for Self-Funding patients)
Refunds will be issued at our discretion if a consultation is materially disrupted due to our fault.
Refunds will not be issued in the following (non-exhaustive) circumstances:
Refund requests must be submitted in writing promptly.

11. Disclaimers
Medical Disclaimer
Clinicians are independent practitioners and not employees of Berkeley Psychiatrists. We do not guarantee any specific treatment outcomes.
You must seek appropriate emergency medical assistance where necessary.
Content Disclaimer
Website content (excluding consultation advice) does not constitute medical advice.
General Disclaimer
We do not guarantee that the Platform will be secure, uninterrupted, or error-free.
12. DVLA & ADHD
ADHD is a neurodevelopmental condition present from childhood. A later diagnosis does not invalidate a previously passed driving test.
According to DVLA guidance, you need only notify the DVLA if your condition affects your ability to drive safely, or if medication produces side effects affecting driving. Patients should seek advice from their doctor if uncertain.
13. Service Reliability
We do not guarantee uninterrupted or error-free operation of the Platform. Data restoration following system failure may take several days.
14. Intellectual Property
All intellectual property rights in the Website, Services, and consultation recordings are owned by Berkeley Psychiatrists Ltd.
You may not reproduce or commercially exploit any materials without permission.
15. Third-Party Rights
These Terms are between you and Berkeley Psychiatrists only. No third party has enforcement rights under them.
16. Applicable Law
These Terms are governed by English law. Proceedings may be brought in the appropriate courts of England, Scotland, or Northern Ireland depending on your residence.
17–18. Severability and Waiver
If any provision is held unenforceable, the remaining provisions remain valid. Delay in enforcing a right does not constitute waiver of that right.
19. PIP, Medication Titration and ECG Referrals
Assistance with Personal Independence Payment (PIP) applications is at the Clinician’s discretion.
Where clinically indicated, and where Patients are referred via Kent and Medway ICB or Kent Community Health NHS Foundation Trust, we may refer Patients to KIMS Hospital (Maidstone) for ECG testing.
